The terms for using this website, booking an intro call and applying to test the Ivary service.
These terms
These Terms of Service (the "Terms") are an agreement between you and Ivary, a business based in Sydney, New South Wales, Australia ("Ivary", "we", "us", "our"). They apply to the website at ivary.ai (the "Website"), to intro calls you book with us, and to applications to test the Ivary service.
By using the Website, booking a call or applying to test, you agree to these Terms. If you do not agree, do not use the Website.
The Website is for businesses. If you book a call or apply to test on behalf of a business, you confirm that you are at least 18 years old and have authority to act for that business.
The Ivary service itself is not yet generally available. Any trial or use of it will be governed by a separate written agreement that we give you before it starts, together with the terms and privacy policy that apply to the service at that time.
Using the Website
You may view the Website and use it to learn about Ivary, contact us and book a call. You may not copy, scrape, frame, mirror or republish the Website, use automated tools to access it other than ordinary search engine indexing, interfere with its operation or security, or use it for any unlawful purpose.
The Website is general information about Ivary. It is not advice, and we may change or remove any part of it at any time. The example builder, clients, trades, addresses and figures shown on it (such as Harlow Homes, S. & M. Calder and 36 Amberfield Dr) are fictional illustrations and do not depict real projects, prices or people.
Intro calls and tester applications
- Booking an intro call runs through Cal.com, which has its own terms and privacy policy. A booking is a request for a conversation, nothing more. Either of us may reschedule or cancel it.
- Applying to test the Ivary service is an expression of interest. We set each tester up by hand and may limit the number of places, so we do not promise to accept every application, and you are not committed to anything by applying.
- If we agree to run a trial with you, the trial will be set out in a separate written agreement: what we provide, what you provide, that no fee is payable, that either side can stop at any time, and confidentiality both ways. Nothing on the Website or in these Terms creates that agreement.
- Anything you tell us about your business in a call or an application is treated as confidential and used only to assess and prepare a trial, as our Privacy Policy describes.
Your information
Our Privacy Policy explains what we collect through the Website, by email and when you book a call, how we use it, and how to access, correct or delete it. It forms part of these Terms.
Intellectual property
We own, or are licensed to use, everything on the Website: the text, the illustrations, the design, the software and the Ivary name. You may not use any of it except to view the Website, and you may not use the Ivary name or logo without our written consent. If you give us feedback about Ivary, you allow us to use it without obligation to you.
Third-party services
The Website uses Cal.com for bookings and may link to other websites and services. Those are provided by third parties under their own terms and privacy policies. We are not responsible for them, and a link is not an endorsement.
Disclaimers and liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Otherwise, and to the extent the law permits: the Website is provided as is and we do not warrant that it will be available, accurate, complete or free of errors; we are not liable for any loss or damage, including indirect or consequential loss, arising from your use of the Website or your reliance on anything on it; and our total liability to you in connection with the Website is limited to A$100.
Changes to these Terms
We may update these Terms from time to time. The effective date and version at the top of the page show when they last changed, and the version on the Website is the one that applies. Continuing to use the Website after a change means you accept the updated Terms.
Governing law
These Terms are governed by the laws of New South Wales, Australia. Each of us submits to the exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them. If any part of these Terms is invalid or unenforceable, it is severed and the rest continues to apply.
